State Senator Sylvia Allen responds to SB1070

I’m Arizona State Senator Sylvia Allen. I want to explain SB 1070 for which I voted yes. Rancher Robert Krentz was murdered by the drug cartel on his ranch a month ago. I participated in a senate hearing two weeks ago on the border violence, here is just some of the highlights from those who testified.
The people who live within 60 to 80 miles of the Arizona/Mexico Border have for years been terrorized and have pleaded for help to stop the daily invasion of humans who cross their property . One Rancher testified that 300 to 1200 people a DAY come across his ranch vandalizing his property, stealing his vehicles and property, cutting down his fences, and leaving trash. In the last two years he has found 17 dead bodies and two Koran bibles. Another rancher testified that daily drugs are brought across his ranch in a military operation. A point man with a machine gun goes in front, 1/2 mile behind are the guards fully armed, 1/2 mile behind them are the drugs, behind the drugs 1/2 mile are more guards. These people are violent and they will kill anyone who gets in the way. This was not the only rancher we heard that day that talked about the drug trains. One man told of two illegal’s who came upon his property one shot in the back and the other in the arm by the drug runners who had forced them to carry the drugs and then shot them. Daily they listen to gun fire during the night it is not safe to leave his family alone on the ranch and they can’t leave the ranch for fear of nothing being left when they come back.

The border patrol is not on the border. They have set up 60 miles away with check points that do nothing to stop the invasion. They are not allowed to use force in stopping anyone who is entering. They run around chasing them, if they get their hands on them then they can take them back across the border. Federal prisons have over 35% illegal’s and 20% of Arizona prisons are filled with illegal’s. In the last few years 80% of our law enforcement that have been killed or wounded have been by an illegal. The majority of people coming now are people we need to be worried about. The ranchers told us that they have seen a change in the people coming they are not just those who are looking for work and a better life.
The Federal Government has refused for years to do anything to help the border states . We have been over run and once they are here we have the burden of funding state services that they use. Education costs have been over a billion dollars. The healthcare cost billions of dollars. Our State is broke, $3.5 billion deficit and we have many serious decisions to make. One is that we do not have the money to care for any who are not here legally. It has to stop.
The border can be secured. We have the technology and we have the ability to stop this invasion. We must know who is coming and they must come in an organized manner legally so that we can assimilate them into our population and protect the sovereignty of our country. We are a nation of laws. We have a responsibility to protect our citizens and to protect the integrity of our country and the government which we live under. I would give amnesty today to many, but here is the problem, we dare not do this until the Border is secure. It will do no good to give them amnesty because thousands will come behind them and we will be over run to the point that there will no longer be the United States of America but a North American Union of open borders. I ask you what form of government will we live under? How long will it be before we will be just like Mexico , Canada or any of the other Central American or South American country? We have already lost our language, everything must be printed in Spanish. We have already lost our history, it is no longer taught in our schools, and we have lost our borders.
The leftist media has distorted what SB 1070 will do. It is not going to set up a Nazi Germany. Are you kidding? The ACLU and the leftist courts will do everything to protect those who are here illegally, but it was an effort to try and stop illegal’s from setting up businesses, and employment, and receiving state services and give the ability to local law enforcement when there is probable cause, like a traffic stop, to determine if they are here legally. Federal law is very clear, if you are here on a visa you must have your papers on you at all times. That is the law. In Arizona all you need to show you are a legal citizen is a driver license, MVD identification card, Native American Card, or a Military ID. This is what you need to vote or get a hunting license. So nothing new has been added to this law. No one is going to be stopped walking down the street. The Socialists who are in power in DC are angry because we dare try and do something.The Socialists wants us to just let them come. They want the “Transformation” to continue.
Maybe it is too late to save America . Maybe we are not worthy of freedom anymore. But as an elected official I must try to do what I can to protect our Constitutional Republic . Living in America is not a right just because you can walk across the border. Being an American is a responsibility and it comes by respecting and upholding the Constitution, the law of our land, which says what you must do to be a citizen of this country. FREEDOM IS NOT FREE.

Karl Rove was one of the keynote speakers at this year's annual National Council of La Raza Conference. The event was held in Los Angeles (the eventual capital of Atzlan). Other speakers included Jesse Jackson, Bill Clinton, and the virulent racist L.A. Mayor Antonio Villaraigosa. The fact that Karl Rove is the President's top political adviser and addressed the group with Bush's blessing, is a strong indicator that this nation is being subverted at the very highest levels. SEN. HARRY REID’S LA RAZA CONNECTION:
One of La Raza's biggest supporters is Sen. Harry Reid (D-NV). In 2001, Reid asked the Senate Appropriations Committee for $5 million to help further the racist goals of that organization. That same year, La Raza gave Sen. Reid their Capital Award for "his commitment to advance legislation priorities of the Latino community." Reid in turn praised La Raza by saying: "La Raza is like the biblical David, fighting all these Goliaths." Taxpayer funds are also funneled to La Raza through the Department of Health and Human Services, The Environmental Protection Agency, and even NASA. Tax dollars are hidden in these government agencies, earmarked to be specifically given away to La Raza. Inside the halls of Congress, the practice is known as discretionary funding...In the real world it is known as money laundering! In 2005, $7.9 million was stolen from the American taxpayers and given out to Latino-only charter schools in the form of U.S. Department of Education grants. The following is a list of a few of those schools: -La Academia Semillas del Pueblo (Los Angeles) -Atzlan Academy (Tucson, AZ) -Mexicayotl Academy (Nogales, AZ) -The Dolores Huerta Prepatory High School (Pueblo, CO) -Academia Cesar Chavez Charter School (St. Paul, MN) These schools stress Latino culture, the Spanish language, the reconquest of the American Southwest, ethnic cleansing and the establishment of the mythical Atzlan, and even Aztec math!...Again, all taught on your dime! When 200 hispanic students skipped school last week and marched through downtown Morgan Hill, California chanting "Si se puede" intermixed with "We want respect," none were banned from school attendance on their return.

And when they refused to surrender their first amendment right to expression, they were given unexcused absences.
Assistant Principal Miguel Rodriguez called the flag draped wardrobe "incendiary" because the students had chosen to worn them on May 5, popularly known as Cinco de Mayo. (A date that "celebrates" Mexico's defeat of the French in a single battle, in a war that Mexico eventually lost.)
The school's administration went further in claiming the five students were attempting "to start a fight" and "adding fuel to the fire."
Latino parents chimed in and chided the five students (one of which is of Mexican ethnic heritage) saying, "we're all offended by it."
One parent, Teresa Casillas, claimed her hispanic children were upset by the behavior of the boys wearing the flagged shirts, calling it disrespectful.
Yet for all the outcry, not an ounce of proof has erupted that the boys made any actions of provocation--except wear the shirts on Cinco De Mayo.
One of the more ignorant utterances by one of the hispanic student protestors summed up the stupidity best, "It's disrespectful to do it on Cinco de Mayo," said Jessica Cortez, a Live Oak sophomore. "They can be a patriot on some other day. Not that specific day."
And so this is what the argument has been reduced to.
I mean, you do understand don't you that Cinco de Mayo is not even celebrated en masse by Mexicans?
Yet the militant, belligerent, children of latinos living in Morgan Hill are exhibiting symptoms of a problem that is widespread. Raw naked entitlement that not only flouts the laws, but has now led to the limiting of the most legitimate expression whose freedom should always be protected: patriotism.
It was bad enough that the Obama administration went on a systematic campaign to discredit the recent right of the state of Arizona to reinforce federal guidelines for immigration. It was bad enough that the lies were widely told, and never retracted by news agencies that should have known better.

It was worse when tens of thousands of illegals marched on downtown streets without any fear to demand socialized redistribution of rights to those who are not citizens and who disrespect the laws of our nation to even bother themselves with trying to correct course.
Normally, I'm exceedingly compassionate to all people groups who wish to get to America. After all, if they wish to change their identity, support the values of our nation, and identify with the cause of what is true, just, and good, then they should in fact be ideal candidates for American citizenship.
Constantly we are told by media, and "immigration rights activists" (read that: open border apologists) that America is a big enough nation to be able to handle a significant increase in immigration. This is a notion I'm not totally in disagreement with.
Yet there is nothing unconstitutional, unlawful, immoral, or even unkind about asking those who come to politely walk to the end of the fence, be prepared to identify who they are, and state the lawful basis they have for coming through our border gate.
The actions of the 200 students of Morgan Hill marching on the streets of their village though repulsive in it's intent, is a constitutionally protected expression.
So were the actions of five students, one of whom is a child of hispanics, to wear American Flag shirts, shorts, caps, and sneakers if they so wish.
It may be the expression du jour to blame America for the ills of all that goes wrong in the world. Pardon me if I don't.
Principal Boden and Assistant Principal Rodriguez should be fired from Live Oak High School in Morgan Hill, California.
The school board could do so easily.
And if they needed to be politically correct about what they call it, merely label it a permanent unexcused absence.
The families of Los Estados Unidos deserve much better

In all its cacophony and moments of absurdity, this morning's Today show segment on immigration was a supremely edifying example of the confusion, high emotion and complexity of the immigration debate. Matters reached their Alice-in-Wonderland apotheosis when Sen. Dianne Feinstein of California was shown arguing that illegal immigrants are good . . . 'citizens.' Said Feinstein: "They pay taxes, their children are Americans, they go to schools, they're good citizens and they're needed." This was in line with the fait accompli argument advanced by La Raza representative Janet Murguia. She referred to what she estimated as the 11-12 million illegal aliens in the country as "people are working in backbreaking work that nobody else wants to do in this country. We need to . . . understand that they are already part of this country." "They're doing work others won't do" has become the mantra of pro-immigration advocates. Others, such as National Review's Rich Lowry, say that argument is is easily refuted on logical and economic grounds. The morning's other guest was CNN's Lou Dobbs. On outsourcing and trade, I find that Dobbs' populism verges on demagoguery. But here, he was, if you'll excuse the expression . . . en fuego. Guest host Campbell Brown acknowledged that Dobbs has made immigration his issue: "you own it." Dobbs: "You cannot reform immigration if you cannot control immigration. And you cannot control immigration unless you control and secure your own borders. The rest of this is obfuscation and sham." Dobbs denied Campbell's assertion that Congress is doing just that, addressing border security: "If you would like to tell me how they're doing it? They're adding no border patrol. I was talking to Gov. Bill Richardson of NM last night. He was promised 269 border patrolmen this year - he has seen none of them." When Campbell plumped for one of the guest-worker programs, Dobbs fired back: "The 'comprehensive solution' is utter nonsense. It's language that means nothing. The fact is that we don't know how many illegal immigrants are in this country. The estimates range from 11 million to 20 million. . . . [11 million] is being commonly used because it suits the convenience of the agendas of the various parties. Bear Stearns did a study last year in which they extrapolated as many as 20 million illegal immigrants. . . It means a shift of 6-10 congressional seats based on those numbers alone." ZOGBY INTERNATIONAL POLL - 2002 MAJORITY OF MEXICAN POPULATION BELIEVES THE SOUTHWEST TERRITORY OF THE U.S. RIGHTFULLY BELONGS TO MEXICO! Americans and Mexicans have widely divergent views of border issues, according to a new poll by Zogby International.
Zogby found that a large majority of the Mexican population believes the southwest territory of the U.S. rightfully belongs to Mexico, and that Mexicans should have the right to enter the U.S. without first obtaining U.S. permission. By contrast, Zogby's survey of Americans conducted within a few days of the Mexican poll shows a large majority supports reducing immigration levels and wants the military deployed along the border to protect the U.S. from illegal immigration. Zogby's poll found that 58 percent of Mexicans agree with the statement, "the territory of the United States' Southwest rightfully belongs to Mexico." Only 28 percent disagree, and 14 percent are unsure. A similar majority, 57 percent, agree with the statement, "Mexicans should have the right to enter the U.S. without U.S. permission," while 35 percent disagree. Seven percent are unsure. The survey has a margin of error of 3.5 percent. The Mexico portion of the survey was conducted in Spanish between May 25 and May 26 among 801 adults chosen at random throughout Mexico. The poll was commissioned by Americans for Immigration Control, Inc. (AIC), which advocates increased restrictions on immigration. "There is obviously a large and significant gap between the attitudes of Americans and Mexicans," said Robert Goldsborough, AIC president. "While most Americans want immigration reduced, most Mexicans think they don't even need permission to enter our country. The poll clearly shows there is less common ground for immigration negotiations between Mexico and the U.S. than the leaders think. Support for a porous border and a loose migration policy occurs only on the Mexican side, not in the U.S." Zogby's survey of American attitudes found wide majorities of Americans also oppose amnesty for illegal aliens. The U.S. portion of the survey was conducted of 1,015 likely voters in the U.S. from May 28 to May 30. It found that 65 percent disagree with the statement, "foreigners residing illegally in the U.S. should be given amnesty." Just 26 percent of likely voters support amnesty for illegals, while 9 percent are unsure. A large majority, 58 percent, agree that the U.S. should "admit fewer immigrants each year." Only 6 percent want "more immigrants each year," and 30 percent want to "keep immigration at the current annual levels." The single largest majority in the entire poll was found among Americans supporting use of the military to guard the border. Fully 68 percent of those surveyed agree with the statement, "the U.S. should deploy military troops on the border as a temporary measure to help the U.S. Border Patrol curb illegal immigration." Only 28 percent disagree, and 3 percent are unsure.

Immigration's Third World Momentum Crime Wave

Last summer, in Boulder, Colorado, eight illegal aliens raped eight American woman. The aliens fled back to Mexico. One was caught. In a nearby city of Longmont, a used car dealer was driven out of business because he suffered so much theft from his lot that he bankrupted. An illegal alien killed a California cop, John Marsh, last year. Robberies and break-ins have become the norm in California. They’ve become the pattern in Florida, Georgia, North Carolina and dozens of other states. But the sobering realities concerning these crimes point to one fact--they are illegal aliens. They are importing themselves into this country with a vengeance. They are deadly, pernicious and organized. They represent the worst of what is common in the Third World.
In her recent scathing report, ‘THE ILLEGAL ALIEN CRIME WAVE’ by brilliant investigative reporter, Heather MacDonald, our country is being assaulted by a crime wave that grows steadily and viciously. A full 95% of all outstanding warrants for homicide, which totaled 1,500 last year in Los Angeles, pointed to illegal aliens. Soberingly, two thirds of all fugitive felony warrants, totaling a horrifying 17,000, were for illegal aliens. To make matters worse, in 1995 a report showed that 60% of the 20,000-strong 18th Street gang in southern California was composed of illegal aliens. That gang collaborates with the Mexican Mafia on drug distribution schemes, extortion and drive-by assassinations. They commit assault and robberies every day of the week. A night of crime to them is like a day of work for American citizens.
How did it come about and why is it spreading? In 1979, Los Angeles Police Department Chief Daryl Gates enacted Special Order 40. Astoundingly, as if insanity took the front row seat in their minds, leaders of dozens of cities from San Francisco to Miami and New York City—adopted this special order. This law prohibits police officers from arresting illegal aliens. In reality, it’s a carte blanche invitation for crime to grow in our country, putting citizens at risk for their lives.
"If I see a deportee from the Mara Salvatrucha prison in El Salvador crossing the street in LA, I can’t touch him," said a Los Angeles police officer. "I can’t arrest him for an immigration felony."
Boulder, Colorado practices the same ‘sanctuary’ policy for illegal aliens. The mayor of the city openly encourages illegal aliens by making sure the police chief does not arrest illegals. Some of Boulder’s immigration lawyers were so bold as to offer publicly announced classes for illegal aliens on how to avoid arrest, detention and deportation by immigration agents. The result in that town shows a tripling of the illegal alien population as well as jobs taken away from citizens and the eight violent rapes.
Not far away in Denver last week, an illegal alien, Javier Cruz-Caballero, purposely ran down police officer, Robert Bryant, while the officer operated a radar gun in a school walk zone. Witnesses saw the Mexican national rev up his engine while taking dead-aim at the officer. Bryant flew 30 feet through the air while suffering a broken leg and head lacerations. He could have easily been killed.
At a greater level, New York’s Mayor Bloomberg supports illegal alien crime by maintaining a ‘sanctuary policy’ in that city. Last year, four illegals raped and killed a New York jogger. That crime was one of thousands of crimes committed by illegal aliens who are protected from the law. But more horrific in impact of this loss of the rule-of-law, former Mayor Guiliana practiced Special Order 40. Several illegal aliens protected by the Order participated in 9/11. The death toll reached 2,800, but the impact on our nation reverberates today. Yet, Special Order 40 continues full force in protecting the estimated 10 million illegal aliens in our country.
However, thousands of them are killing, raping, robbing and driving illegally in our country. Over 400,000 deportees continue walking around free in our country. The ones that commit crimes and are caught make up a full 29% of our prison populations. They cost American taxpayers nearly $1 billion annually to feed, house and care for them in our prisons. And, yet, Special Order 40, continues as if it was a fig leaf for welcoming hardened alien criminals.
These examples of illegal immigrant crime depict a growing menace to our functioning society. While a sleepy American public watches idly and a Congress refuses to enforce our borders while mayors adopt the ‘sanctuary policy’, we citizens receive an average of 2,200 illegals every 24 hours, seven days a week, 365 days per year. Since the Amnesty policy was announced, the invasion intensifies with greater numbers.
Where does that leave you? If you’re in California, you’re planning on moving to Idaho or Montana because it’s already too late. With over 3.5 million illegals, the crime wave is beyond stopping. If you’re in Georgia, you’re probably stewing under your breath, but you don’t have a clue that it’s going to get worse. In Chicago, they either take jobs or rob banks or set up drug, prostitution and theft rings. If you’re in Florida, it is no longer an American city. Houston is just as bad. It grows worse in every city in America.
It’s called ‘THIRD WORLD MOMENTUM’. The key is to understand that in the Third World--corruption, crime, child prostitution, bashing in peoples’ heads, torture and worse is the norm. Why? Because the rule-of-law no longer applies. Today, in America, concerning illegal immigration, our public officials who were sworn to uphold the Constitution have abstained from their oaths of office. We’re forced NOT to talk about it via being politically correct, yet we are the victims of our own silence.
Because the American public still hasn’t figured this crisis out or keeps thinking it will go away on its own—IT IS GOING TO GET WORSE—and you or your loved ones will become victims given enough time. With Special Order 40 in your city, another 9/11 can’t be far off!

Some of the most violent criminals at large today are illegal aliens. Yet in cities where the crime these aliens commit is highest, the police cannot use the most obvious tool to apprehend them: their immigration status. In Los Angeles, for example, dozens of members of a ruthless Salvadoran prison gang have sneaked back into town after having been deported for such crimes as murder, assault with a deadly weapon, and drug trafficking. Police officers know who they are and know that their mere presence in the country is a felony. Yet should a cop arrest an illegal gangbanger for felonious reentry, it is he who will be treated as a criminal, for violating the LAPD’s rule against enforcing immigration law.

The Arizona law has the salutary purpose of increasing the chance that any given illegal alien will be lawfully detected and deported, but the record suggests that a huge percentage of individuals apprehended under the law will simply illegally reenter.

This ICE press release boasts of success stories from the Secure Communities program, which under the Obama administration focuses on identifying and deporting only the most serious criminal aliens. It presents 26 cases in which violent or otherwise serious offenders were apprehended since late 2008; a full 13 of them had already been deported, many multiple times.

The record for reentry goes to a Mexican aggravated felon apprehended in Florence, Ariz., on May 22, 2009, who had been deported nine times, following 51 documented arrests under 16 different aliases. The runner-up is a Mexican arrested for assault causing bodily injury on June 9, 2009, in Starr County, Texas, who had been deported five times and was convicted of attempted murder in 2005. More typical is a Guatemalan drug dealer apprehended in Dallas on Aug. 7, 2009, who has been deported twice, and whose lengthy criminal history includes aggravated assault with a deadly weapon (legalese for shooting someone); a Honduran MS-13 gang member booked on March 8, 2009, in Boston, who had previously been removed once; and a Mexican gang member arrested for strong arm aggravated assault in Maricopa County, Ariz., who had been previously convicted of aggravated assault with a deadly weapon and deported once.

The logic of the Arizona law is that by increasing the chance of detection, it will discourage illegal aliens from entering in the first place and encourage those already in the country to leave on their own. Undoubtedly, many people will respond to the law as intended; the deterrent effect would be even greater if more states followed Arizona’s lead and discarded their actual or de facto sanctuary policies. But for other illegal aliens, the threat of detection and deportation is apparently not particularly meaningful. I don’t know whether the rate of illegal reentry (which is a felony) is higher for serious criminal aliens compared with illegal aliens who do not commit other crimes. But clearly, better interior enforcement, while a necessary part of restoring the immigration rule of law, cannot succeed in the absence of a truly secure border. The only reason for not creating a border fence that I can see is ambivalence about whether we really want to prevent illegal entry.

Audit looks at migrant re-arrests

WASHINGTON - Some illegal immigrants are being released from prison only to be arrested on new charges despite government efforts to deport them and keep them out of the country.

The findings are part of an audit by Justice Department Inspector General Glenn Fine that suggest authorities are still struggling to deport illegal immigrants who commit crimes, even though most state and local authorities are notifying immigration authorities of the imminent release of prisoners.

Fine's office analyzed the cases of 100 immigrants who had served time in prison and found 73 of them were rearrested after being released.

On average, each immigrant was rearrested six times, ranging from traffic violations to assault.

Fine's office couldn't determine how many illegal immigrants had been rearrested overall because immigration authorities don't keep track.

If the sample was any indication, "The rate at which released criminal aliens are rearrested is extremely high," the report said.

Last year, Homeland Security's inspector general said immigration authorities expected that most of the 300,000 illegal and legal immigrants eligible to be deported would be released.

Federal officials said they would need 34,000 additional beds at a cost of $1.1 billion to detain and remove all of them.

Illegal Aliens Abscond Under “Humane” ICE Program

Touted by the Obama Administration as key to overhauling the nation’s immigration detention system, a program that monitors illegal aliens instead of jailing them regularly loses track of offenders and the government distorts records to cover it up.
Operated by Immigration and Customs Enforcement (ICE), the intensive monitoring program allows illegal aliens to check in by phone, wear ankle monitors and obey a curfew rather than go to prison while they wait for court appearances. ICE claims the alternatives-to-detention program is a huge success and Obama assures it’s a great model for his plans to create a more humane immigration detention system.
But records and statistics obtained by a Houston newspaper under the Freedom of Information Act (FOIA) tell a much different story. Nearly one in five illegal immigrants who participated in the tracking project absconded while under supervision during the last five years, according to the records. Authorities were unable to locate nearly 20% of 6,373 illegal aliens enlisted in the program during that time. About 5% were subsequently rearrested for other matters.
ICE brags about a near perfect success rate because it simply erases those who absconded from the records as if they never existed. The Department of Homeland Security’s largest investigative agency, with about 20,000 employees and 400 offices worldwide, includes only active participants when it calculates its heavily altered statistics.
Based on the blatantly misleading data, Homeland Security Secretary Janet Napolitano is working to expand the alternatives-to-detention program, which currently has about 20,000 participants. The former Arizona governor, who has a documented history of opposing immigration enforcement, will submit a proposal to Congress before year’s end in hopes of accomplishing that goal.

Illegal Aliens Sue ICE Over Arrests

A group of illegal immigrants recently spared deportation by a sympathetic Connecticut judge are suing the federal agents that arrested them, claiming their constitutional rights were violated in the raids that led to their apprehension.
The illegal aliens, who live in New Haven, assert in a federal lawsuit that Immigration and Customs Enforcement (ICE) agents violated their rights during an early-morning fugitive operation in 2007 that led to the arrest of 30 people. Seventeen of them were subsequently charged with being in the U.S. illegally and a group of law students from a nearby Ivy League university represented them pro bono.
In August a federal judge (Michael Straus) in Connecticut blocked the deportation of four of the illegal aliens, ruling that their constitutional rights were “egregiously violated” because immigration agents entered their apartments without a warrant, probable cause or consent. Besides terminating removal proceedings, the judge suppressed any evidence gathered by federal agents because the illegal aliens’ constitutional protections to due process were violated.
Evidently emboldened by the ruling, the illegal immigrants are now suing the agents who conducted the raids, their supervisors and senior ICE officials. Weapons drawn, agents entered the illegal aliens’ homes without cause, consent or search warrants, according to the complaint filed this week. It further says that authorities had not previously determined that most of the arrested were in violation of immigration law and therefore had no reason to assume that they lacked legal status.
The lawsuit also declares that the feds deliberately conducted raids in New Haven to retaliate against the city for its well-known efforts to accommodate illegal immigrants. A few years ago New Haven became the nation’s first to offer illegal aliens official identification cards so that they can enjoy public services and integrate into the community. San Francisco followed its lead and began offering illegal immigrants ID cards this year.

The Justice findings by department Inspector General Glenn A. Fine examined the criminal histories of 100 illegal immigrants arrested and then released by local and state authorities in 2004, the latest complete data available. Of the sample group of 100, according to the audit, 73 immigrants were later arrested a collective 429 times - on charges ranging from traffic tickets to weapons and drug charges.

The data suggest "the rate at which released criminal aliens are re-arrested is extremely high," the audit noted. The report, parts of which were redacted, was required by Congress in 2005 and looked at how local and state authorities that receive Justice Department funding are working with the Homeland Security Department.

For years, the government was forced to release thousands of illegal immigrants who were caught in the United States because of not enough jail space and other resources. But last fall, with immigration as a key election-year priority, Homeland Security declared it would detain 99 percent of non-Mexican illegal immigrants until they could be returned to their home nations. The policy generally does not apply to Mexicans, who are almost immediately returned to Mexico after being stopped by Border Patrol agents.

The Justice audit, however, only looked at immigrants who were arrested and released by local and state authorities before they could be turned over to Homeland Security to be detained or deported. In all, 752 cities, counties and states participating in the program received $287 million in 2005, the audit noted.

Five states - California, New York, Texas, Florida and Arizona - received the bulk of the money, together pulling in more than $184 million.

Assistant Attorney General Regina B. Schofield, who oversees the Office of Justice Programs that controlled the funding, declined comment on the audit, noting that it does not contain any recommendations.

A separate report by the Transactional Records Access Clearinghouse at Syracuse University showed that the number of immigrants who were deported as "aggravated felons" doubled over the last 15 years, from 10,303 in 1992 to an estimated 23,065 in 2006.

But TRAC, which obtained the data from the Justice Department's Executive Office of Immigration Review, noted concerns that some of those immigrants never committed felonies.

"An individual can be declared an aggravated felon on the basis of a conviction on misdemeanor charges such as shoplifting," the TRAC report concluded.

Obama soft on illegals enforcement

Arrests of illegal immigrant workers have dropped precipitously under President Obama, according to figures released Wednesday. Criminal arrests, administrative arrests, indictments and convictions of illegal immigrants at work sites all fell by more than 50 percent from fiscal 2008 to fiscal 2009.

The figures show that Mr. Obama has made good on his pledge to shift enforcement away from going after illegal immigrant workers themselves - but at the expense of Americans' jobs, said Rep. Lamar Smith of Texas, the Republican who compiled the numbers from the Department of Homeland Security's U.S. Immigration and Customs Enforcement agency (ICE). Mr. Smith, the top Republican on the House Judiciary Committee, said a period of economic turmoil is the wrong time to be cutting enforcement and letting illegal immigrants take jobs that Americans otherwise would hold.

The Illegal-Alien Crime Wave

Some of the most violent criminals at large today are illegal aliens. Yet in cities where the crime these aliens commit is highest, the police cannot use the most obvious tool to apprehend them: their immigration status. In Los Angeles, for example, dozens of members of a ruthless Salvadoran prison gang have sneaked back into town after having been deported for such crimes as murder, assault with a deadly weapon, and drug trafficking. Police officers know who they are and know that their mere presence in the country is a felony. Yet should a cop arrest an illegal gangbanger for felonious reentry, it is he who will be treated as a criminal, for violating the LAPD’s rule against enforcing immigration law.

The LAPD’s ban on immigration enforcement mirrors bans in immigrant-saturated cities around the country, from New York and Chicago to San Diego, Austin, and Houston. These “sanctuary
policies” generally prohibit city employees, including the cops, from reporting immigration violations to federal authorities.

Such laws testify to the sheer political power of immigrant lobbies, a power so irresistible that police officials shrink from even mentioning the illegal-alien crime wave. “We can’t even talk
about it,” says a frustrated LAPD captain. “People are afraid of a backlash from Hispanics.” Another LAPD commander in a predominantly Hispanic, gang-infested district sighs: “I would get a firestorm of criticism if I talked about [enforcing the immigration law against illegals].” Neither captain would speak for attribution.

But however pernicious in themselves, sanctuary rules are a symptom of a much broader disease: the nation’s near-total loss of control over immigration policy. Fifty years ago, immigration policy might have driven immigration numbers, but today the numbers drive policy. The nonstop increase of immigration is reshaping the language and the law to dissolve any distinction between legal and illegal aliens and, ultimately, the very idea of national borders.

It is a measure of how topsy-turvy the immigration environment has become that to ask police officials about the illegal-alien crime problem feels like a gross faux pas, not done in polite company. And a police official asked to violate this powerful taboo will give a strangled response—or, as in the case of a New York deputy commissioner, break off communication altogether. Meanwhile, millions of illegal aliens work, shop, travel, and commit crimes in plain view, utterly secure in their de facto immunity from the immigration law.

I asked the Miami Police Department’s spokesman, Detective Delrish Moss, about his employer’s policy on lawbreaking illegals. In September, the force arrested a Honduran visa violator for seven vicious rapes. The previous year, Miami cops had had the suspect in
custody for lewd and lascivious molestation, without checking his immigration status. Had they done so, they would have discovered his visa overstay, a deportable offense, and so could have forestalled the rapes. “We have shied away from unnecessary involvement dealing with immigration issues,” explains Moss, choosing his words carefully, “because of our large immigrant population.”

Police commanders may not want to discuss, much less respond to, the illegal-alien crisis, but its magnitude for law enforcement is startling. Some examples:

• In Los Angeles, 95 percent of all outstanding warrants for homicide (which total 1,200 to 1,500) target illegal aliens. Up to two-thirds of all fugitive felony warrants (17,000) are for illegal aliens.

• A confidential California Department of Justice study reported in 1995 that 60 percent of the 20,000-strong 18th Street Gang in southern California is illegal; police officers say the proportion is actually much greater. The bloody gang collaborates with the Mexican Mafia,
the dominant force in California prisons, on complex drug-distribution schemes, extortion, and drive-by assassinations, and commits an assault or robbery every day in L.A. County. The gang
has grown dramatically over the last two decades by recruiting recently arrived youngsters, most of them illegal, from Central America and Mexico.

• The leadership of the Columbia Lil’ Cycos gang, which uses murder and racketeering to control the drug market around L.A.’s MacArthur Park, was about 60 percent illegal in 2002, says former assistant U.S. attorney Luis Li. Francisco Martinez, a Mexican Mafia member and an illegal alien, controlled the gang from prison, while serving time for felonious reentry following deportation.

Good luck finding any reference to such facts in official crime analysis. The LAPD and the L.A. city attorney recently requested an injunction against drug trafficking in Hollywood, targeting the 18th Street Gang and the “non–gang members” who sell drugs in Hollywood for the gang. Those non–gang members are virtually all illegal Mexicans, smuggled into the country by a ring organized by 18th Street bigs. The Mexicans pay off their transportation debts to the gang by selling drugs; many soon realize how lucrative that line of work is and stay in the business.

Cops and prosecutors universally know the immigration status of these non-gang “Hollywood dealers,” as the city attorney calls them, but the gang injunction is assiduously silent on the matter. And if a Hollywood officer were to arrest an illegal dealer (known on the
street as a “border brother”) for his immigration status, or even notify the Immigration and Naturalization Service (since early 2003, absorbed into the new Department of Homeland Security), he would face severe discipline for violating Special Order 40, the city’s sanctuary policy.

L.A.’s sanctuary law and all others like it contradict a key 1990s policing discovery: the Great Chain of Being in criminal behavior. Pick up a law-violator for a “minor” crime, and you might well prevent a major crime: enforcing graffiti and turnstile-jumping laws nabs you murderers and robbers. Enforcing known immigration violations, such as reentry following deportation, against known felons, would be even more productive. LAPD officers recognize illegal deported gang members all the time—flashing gang signs at court hearings for rival gangbangers, hanging out on the corner, or casing a target. These illegal returnees are, simply by being in the country after deportation, committing a felony (in contrast to garden-variety illegals on their first trip to the U.S., say, who are only committing a misdemeanor). “But if I see a deportee from the Mara Salvatrucha [Salvadoran prison] gang crossing the street, I know I can’t touch him,” laments a Los Angeles gang officer. Only if the deported felon has given the officer some other reason to stop him, such as an observed narcotics sale, can the cop accost him—but not for the mmigration felony.

The stated reasons for sanctuary policies are that they encourage illegal-alien crime victims and witnesses to cooperate with cops without fear of deportation, and that they encourage illegals to take advantage of city services like health care and education (to whose maintenance few illegals have contributed a single tax dollar, of course). There has never been any empirical verification that sanctuary laws actually accomplish these goals—and no one has ever suggested not enforcing drug laws, say, for fear of intimidating drug-using crime victims. But in any case, this official rationale could be honored by limiting police use of immigration laws to some subset of immigration violators: deported felons, say, or repeat criminal offenders whose immigration status police already know.

The real reason cities prohibit their cops and other employees from immigration reporting and enforcement is, like nearly everything else in immigration policy, the numbers. The immigrant population has grown so large that public officials are terrified of alienating it, even at the expense of ignoring the law and tolerating violence. In 1996, a breathtaking Los Angeles Times exposé on the 18th Street Gang, which included descriptions of innocent bystanders being murdered by laughing cholos (gang members), revealed the rate of illegal-alien
membership in the gang. In response to the public outcry, the Los Angeles City Council ordered the police to reexamine Special Order 40. You would have thought it had suggested reconsidering Roe v. Wade. A police commander warned the council: “This is going to open
a significant, heated debate.” City Councilwoman Laura Chick put on a brave front: “We mustn’t be afraid,” she declared firmly.

But of course immigrant pandering trumped public safety. Law-abiding residents of gang-infested neighborhoods may live in terror of the tattooed gangbangers dealing drugs, spraying graffiti, and shooting up rivals outside their homes, but such anxiety can never equal a
politician’s fear of offending Hispanics. At the start of the reexamination process, LAPD deputy chief John White had argued that allowing the department to work closely with the INS would give cops another tool for getting gang members off the streets. Trying to build a homicide case, say, against an illegal gang member is often futile, he explained, since witnesses fear deadly retaliation if they cooperate with the police. Enforcing an immigration violation would allow the cops to lock up the murderer right now, without putting a witness’s life at risk.

But six months later, Deputy Chief White had changed his tune: “Any broadening of the policy gets us into the immigration business,” he asserted. “It’s a federal law-enforcement issue, not a local law-enforcement issue.” Interim police chief Bayan Lewis told the L.A. Police ommission: “It is not the time. It is not the day to look at Special Order 40.”

Nor will it ever be, as long as immigration numbers continue to grow. After their brief moment of truth in 1996, Los Angeles politicians have only grown more adamant in defense of Special Order 40. After learning that cops in the scandal-plagued Rampart Division had cooperated with the INS to try to uproot murderous gang members from the community, local politicians threw a fit, criticizing district commanders for even allowing INS agents into their station houses. In
turn, the LAPD strictly disciplined the offending officers. By now, big-city police chiefs are unfortunately just as determined to defend sanctuary policies as the politicians who appoint them; not so the rank and file, however, who see daily the benefit that an immigration tool would bring. But even were immigrant-saturated cities to discard their sanctuary policies and start enforcing immigration violations where public safety demands it, the resource-starved immigration authorities couldn’t handle the overwhelming additional workload.

The chronic shortage of manpower to oversee, and detention space to house, aliens as they await their deportation hearings (or, following an order of removal from a federal judge, their actual deportation) has forced immigration officials to practice a constant triage. Long ago, the feds stopped trying to find and deport aliens who had “merely” entered the country illegally through stealth or fraudulent documents. Currently, the only types of illegal aliens who run any risk of catching federal attention are those who have been convicted of an “aggravated felony” (a particularly egregious crime) or who have been deported following conviction for an
aggravated felony and who have reentered (an offense punishable with 20 years in jail).

That triage has been going on for a long time, as former INS investigator Mike Cutler, who worked with the NYPD catching Brooklyn drug dealers in the 1970s, explains. “If you arrested someone you wanted to detain, you’d go to your boss and start a bidding war,” Cutler recalls. “You’d say: 'My guy ran three blocks, threw a couple of punches, and had six pieces of ID.' The boss would turn to another agent: 'Next! Whaddid your guy do?' 'He ran 18 blocks, pushed
over an old lady, and had a gun.' ” But such one-upmanship was usually fruitless. “Without the jail space,” explains Cutler, “it was like the Fish and Wildlife Service; you’d tag their ear
and let them go.”

But even when immigration officials actually arrest someone, and even if a judge issues a final deportation order (usually after years of litigation and appeals), they rarely have the manpower to put the alien on a bus or plane and take him across the border. Second alternative: detain him pending removal. Again, inadequate space and staff. In the early 1990s, for example, 15 INS officers were in charge of the deportation of approximately 85,000 aliens (not all of them criminals) in New York City. The agency’s actual response to final orders of removal was what is known as a “run letter”—a notice asking the deportable alien kindly to show up in a month or
two to be deported, when the agency might be able to process him. Results: in 2001, 87 percent of deportable aliens who received run letters disappeared, a number that was even higher—94 percent—if they were from terror-sponsoring countries.

To other law-enforcement agencies, the feds’ triage often looks like complete indifference to immigration violations. Testifying to Congress about the Queens rape by illegal Mexicans, New York’s criminal justice coordinator defended the city’s failure to notify the INS after the rapists’ previous arrests on the ground that the agency wouldn’t have responded anyway. “We have time and time again been unable to reach INS on the phone,” John Feinblatt said last February. “When we reach them on the phone, they require that we write a letter. When we write a letter, they quire that it be by a superior.”

Criminal aliens also interpret the triage as indifference. John Mullaly a former NYPD homicide detective, estimates that 70 percent of the drug dealers and other criminals in Manhattan’s Washington Heights were illegal. Were Mullaly to threaten an illegal-alien thug in custody that his next stop would be El Salvador unless he cooperated, the criminal would just laugh, knowing that the INS would never show up. The message could not be clearer: this is a culture
that can’t enforce its most basic law of entry. If policing’s broken-windows theory is correct, the failure to enforce one set of rules breeds overall contempt for the law.

The sheer number of criminal aliens overwhelmed an innovative program that would allow immigration officials to complete deportation hearings while a criminal was still in state or federal prison, so that upon his release he could be immediately ejected without taking
up precious INS detention space. But the process, begun in 1988, immediately bogged down due to the numbers—in 2000, for example, nearly 30 percent of federal prisoners were foreign-born. The agency couldn’t find enough pro bono attorneys to represent such an army of criminal aliens (who have extensive due-process rights in contesting deportation) and so would have to request delay after delay. Or enough immigration judges would not be available. In 1997, the INS simply had no record of a whopping 36 percent of foreign-born inmates who had been released from federal and four state prisons without any review of their deportability. They included 1,198
aggravated felons, 80 of whom were soon re-arrested for new crimes.

Resource starvation is not the only reason for federal inaction. The INS was a creature of immigration politics, and INS district directors came under great pressure from local politicians to divert scarce resources into distribution of such “benefits” as permanent residency, citizenship, and work permits, and away from criminal or other investigations. In the late 1980s, for example, the INS refused to join an FBI task force against Haitian drug trafficking in Miami, fearing criticism for “Haitian-bashing.” In 1997, after Hispanic activists protested a much-publicized raid that netted nearly two dozen illegals, the Border Patrol said that it would no longer join Simi Valley, California, probation officers on home searches of illegal-alien-dominated gangs.

The disastrous Citizenship USA project of 1996 was a luminous case of politics driving the INS to sacrifice enforcement to “benefits.” When, in the early 1990s, the prospect of welfare reform drove immigrants to apply for citizenship in record numbers to preserve their welfare eligibility, the Clinton administration, seeing a political bonanza in hundreds of thousands of new welfare-dependent citizens, ordered the naturalization process radically expedited. Thanks to relentless administration pressure, processing errors in 1996 were 99 percent in New York and 90 percent in Los Angeles, and tens of thousands of aliens with criminal records, including for murder and armed robbery, were naturalized.

Another powerful political force, the immigration bar association, has won from Congress an elaborate set of due-process rights for criminal aliens that can keep them in the country ndefinitely. Federal probation officers in Brooklyn are supervising two illegals—a Jordanian and an Egyptian with Saudi citizenship—who look “ready to blow up the Statue of Liberty,” according to a probation official, but the officers can’t get rid of them. The Jordanian had been caught fencing stolen Social Security and tax-refund checks; now he sells phone cards, which he uses himself to make untraceable calls. The Saudi’s offense: using a fraudulent Social Security number to get employment—a puzzlingly unnecessary scam, since he receives large sums from the Middle East, including from millionaire relatives. But intelligence links him to terrorism,
so presumably he worked in order not to draw attention to himself. Currently, he changes his cell phone every month. Ordinarily such a minor offense would not be prosecuted, but the government, fearing that he had terrorist intentions, used whatever it had to put him in prison.

Now, probation officers desperately want to see the duo out of the country, but the two ex-cons have hired lawyers, who are relentlessly fighting their deportation. “Due process allows you to stay for years without an adjudication,” says a probation officer in frustration. “A regular immigration attorney can keep you in the country for three years, a high-priced one for ten.” In the meantime, Brooklyn probation officials are watching the bridges.

Even where immigration officials successfully nab and deport criminal aliens, the reality, says a former federal gang prosecutor, is that “they all come back. They can’t make it in Mexico.” The tens of thousands of illegal farmworkers and dishwashers who overpower U.S. border controls every year carry in their wake thousands of brutal assailants and terrorists who use the same smuggling industry and who benefit from the same irresistible odds: there are so many more of
them than the Border Patrol.

For, of course, the government’s inability to keep out criminal aliens is part and parcel of its inability to patrol the border, period. For decades, the INS had as much effect on the migration of
millions of illegals as a can tied to the tail of a tiger. And the immigrants themselves, despite the press cliché of hapless aliens living fearfully in the shadows, seemed to regard immigration
authorities with all the concern of an elephant for a flea.

Certainly fear of immigration officers is not in evidence among the hundreds of illegal day laborers who hang out on Roosevelt Avenue in Queens, New York, in front of money wire services, travel agencies, immigration-attorney offices, and phone arcades, all catering to the
local Hispanic population (as well as to drug dealers and terrorists). “There is no chance of getting caught,” cheerfully explains Rafael, an Ecuadoran. Like the dozen Ecuadorans and Mexicans on his particular corner, Rafael is hoping that an SUV seeking carpenters for $100 a day will show up soon. “We don’t worry, because we’re not doing anything wrong. I know it’s illegal; I need the papers, but here, nobody asks you for papers.”

Even the newly fortified Mexican border, the one spot where the government really tries to prevent illegal immigration, looms as only a minor inconvenience to the day laborers. The odds, they realize, are overwhelmingly in their favor. Miguel, a reserved young carpenter, crossed the border at Tijuana three years ago with 15 others. Border Patrol spotted them, but with six officers to 16 illegals, only five got caught. In illegal border crossings, you get what you pay for, Miguel says. If you try to shave on the fee, the coyotes will abandon you at the first problem. Miguel’s wife was flying into New York from Los Angeles that very day; it had cost him $2,200 to get her
across the border. “Because I pay, I don’t worry,” he says complacently.

The only way to dampen illegal immigration and its attendant train of criminals and terrorists—short of an economic revolution in the sending countries or an impregnably militarized border—is to remove the jobs magnet. As long as migrants know they can easily get work, they will find ways to evade border controls. But enforcing laws against illegal labor is among government’s lowest priorities. In 2001, only 124 agents nationwide were trying to find and prosecute the hundreds of thousands of employers and millions of illegal aliens who violate the employment laws, the Associated Press reports.

Even were immigration officials to devote adequate resources to worksite investigations, not much would change, because their legal weapons are so weak. That’s no accident: though it is a crime to hire illegal aliens, a coalition of libertarians, business lobbies, and left-wing advocates has consistently blocked the fraud-proof form of work authorization necessary to enforce that ban. Libertarians have erupted in hysteria at such proposals as a toll-free number to the Social Security Administration for employers to confirm Social Security numbers. Hispanics warn just as stridently that helping employers verify work eligibility would result in discrimination
against Hispanics—implicitly conceding that vast numbers of Hispanics work illegally.

The result: hiring practices in illegal-immigrant-saturated industries are a charade. Millions of illegal workers pretend to present valid documents, and thousands of employers pretend to
believe them. The law doesn’t require the employer to verify that a worker is actually qualified to work, and as long as the proffered documents are not patently phony—scrawled with red crayon on a matchbook, say—the employer will nearly always be exempt from liability merely by having eyeballed them. To find an employer guilty of violating the ban on hiring illegal aliens, immigration authorities must prove that he knew he was getting fake papers—an almost
insurmountable burden. Meanwhile, the market for counterfeit documents has exploded: in one month alone in 1998, immigration authorities seized nearly 2 million of them in Los Angeles, destined for immigrant workers, welfare seekers, criminals, and terrorists.

For illegal workers and employers, there is no downside to the employment charade. If immigration officials ever do try to conduct an industry-wide investigation—which will at least net the illegal employees, if not the employers—local congressmen will almost certainly head it off. An INS inquiry into the Vidalia-onion industry in Georgia was not only aborted by Georgia’s congressional delegation; it actually resulted in a local amnesty for the growers’ illegal workforce. The downside to complying with the spirit of the employment law, on the other hand, is considerable. Ethnic advocacy groups are ready to picket employers who dismiss illegal workers, and employers understandably fear being undercut by less scrupulous competitors.

Of the incalculable changes in American politics, demographics, and culture that the continuing surge of migrants is causing, one of the most profound is the breakdown of the distinction between legal and illegal entry. Everywhere, illegal aliens receive free public education and free medical care at taxpayer expense; 13 states offer them driver’s licenses. States everywhere have been pushed to grant illegal aliens college scholarships and reduced in-state tuition. One hundred banks, over 800 law-enforcement agencies, and dozens of cities accept an identification card created by Mexico to credentialize illegal Mexican aliens in the U.S. The Bush administration has given its blessing to this matricula consular card, over the strong protest of the FBI, which warns that the gaping security loopholes that the card creates make it boon to money launderers, immigrant smugglers, and terrorists. Border authorities have already caught an Iranian man sneaking across the border this year, Mexican matricula card in hand.

Hispanic advocates have helped blur the distinction between a legal and an illegal resident by asserting that differentiating the two is an act of irrational bigotry. Arrests of illegal aliens inside the
border now inevitably spark protests, often led by the Mexican government, that feature signs calling for “no más racismo.” Immigrant advocates use the language of “human rights” to appeal
to an authority higher than such trivia as citizenship laws. They attack the term “amnesty” for implicitly acknowledging the validity of borders. Indeed, grouses Illinois congressman Luis
Gutierrez, “There’s an implication that somehow you did something wrong and you need to be forgiven.”

Illegal aliens and their advocates speak loudly about what they think the U.S. owes them, not vice versa. “I believe they have a right . . . to work, to drive their kids to school,” said California
assemblywoman Sarah Reyes. An immigration agent says that people he stops “get in your face about their rights, because our failure to enforce the law emboldens them.” Taking this idea to its extreme, Joaquín Avila, a UCLA Chicano studies professor and law lecturer, argues that to deny non-citizens the vote, especially in the many California cities where they constitute the majority, is a form of apartheid.

Yet no poll has ever shown that Americans want more open borders. Quite the reverse. By a huge majority—at least 60 percent—they want to rein in immigration, and they endorse an observation that Senator Alan Simpson made 20 years ago: Americans “are fed up with
efforts to make them feel that [they] do not have that fundamental right of any people—to decide who will join them and help form the future country in which they and their posterity will live.” But if the elites’ and the advocates’ idea of giving voting rights to non-citizen majorities catches on—and don’t be surprised if it does—Americans could be faced with the ultimate absurdity of people outside the social compact making rules for those inside it.

However the nation ultimately decides to rationalize its chaotic and incoherent immigration system, surely all can agree that, at a minimum, authorities should expel illegal-alien criminals swiftly. Even on the grounds of protecting non-criminal illegal immigrants, we should start by junking sanctuary policies. By stripping cops of what may be their only immediate tool to remove felons from the community, these policies leave law-abiding immigrants prey to crime.

But the non-enforcement of immigration laws in general has an even more destructive effect. In many immigrant communities, assimilation into gangs seems to be outstripping assimilation into civic culture. Toddlers are learning to flash gang signals and hate the police, reports the Los Angeles Times. In New York City, “every high school has its Mexican gang,” and most 12- to 14-year-olds have already joined, claims Ernesto Vega, an illegal 11-year-old Mexican. Such
pathologies only worsen when the first lesson that immigrants learn about U.S. law is that Americans don’t bother to enforce it. “Institutionalizing illegal immigration creates a mindset in people that anything goes in the U.S.,” observes Patrick Ortega, the news and public-affairs director of Radio Nueva Vida in southern California. “It creates a new subculture, with a sequela of social ills.” It is broken windows writ large.

For the sake of immigrants and native-born Americans alike, it’s time to decide what our immigration policy is—and enforce it.

CALIF. SENATORS PUSH PATH TO CITIZENSHIP

WASHINGTON - California's Democratic senators introduced legislation Wednesday that would put some illegal immigrant farmworkers on a path to citizenship and revamp a little-used agricultural guest-worker program.
Flanked by Republican colleagues, immigrant advocates and a California pear grower, Dianne Feinstein and Barbara Boxer presented the bill as a matter of survival for labor-strapped farmers.
``Today, many farmers are on a precipice,'' Feinstein said. ``Whether they survive to plant another season is determined largely on one simple question: Will there be enough workers to bring in the harvest?''
About 1 million undocumented laborers work California's 76,500 farms, making up about 90 percent of the state's agricultural payroll. Tougher enforcement along the southern border and inside the country has left farmers scrambling for enough hands at harvest time, especially since undocumented workers tend to leave agricultural work for higher-paying jobs in the construction, restaurant and hospitality industries.

Sen. Feinstein plan expands illegals pool

Published May 23, 2006 A Senate Democrat yesterday introduced a proposal to expand the pool of illegal aliens eligible for citizenship to include anyone who sneaked across the border before Jan. 1. Under the amendment filed yesterday afternoon by Sen. Dianne Feinstein of California, all illegals that can prove they arrived before the start of this year would be issued an "orange card," which would provide a path to U.S. citizenship. "This amendment would streamline the process for earned legalization," Mrs. Feinstein said, referring to the process by which an estimated 10 million to 12 million illegals could become citizens. "It would create a more workable and practical program and dedicate the necessary dollars to cover its costs of administration." Under the bill being debated in the Senate, illegal aliens who came into the country within the past two years would still be subject to deportation. Illegals who had been here two years or longer could apply for citizenship. "This means approximately 4.8 million people would be required to leave voluntarily or be deported," Mrs. Feinstein said yesterday in reference to the Senate bill. "I don't believe many of these people would go home. Even President Bush acknowledged that such a large-scale deportation program is unworkable when he said, 'It is neither wise, nor realistic to round up millions of people ... and send them across the border.' " Mrs. Feinstein's amendment would require illegal aliens to immediately register with the Department of Homeland Security and submit fingerprints for criminal and national-security background checks. Once they passed the background checks, they could apply for an orange card. In order to get an orange card, the alien would have to provide evidence they were already in the U.S. on Jan. 1, 2006. As under the current bill, aliens would have to learn English, pay back taxes and $2,000 in fines. Several of Mrs. Feinstein's colleagues were hesitant to comment on her proposal last night, saying they had not had time to study it. It was not clear last night whether or when the amendment would receive a floor vote. Sen. John Cornyn, Texas Republican who adamantly opposes granting amnesty to illegal aliens, said he did not think it would change his opposition to the larger bill as it is currently drafted. "Sounds to me like it has the same infirmities that the current bill does," he said yesterday.

Feinstein Calls Illegals Good 'Citizens', Lou Lets Loose

In all its cacophony and moments of absurdity, this morning's Today show segment on immigration was a supremely edifying example of the confusion, high emotion and complexity of the immigration debate. Matters reached their Alice-in-Wonderland apotheosis when Sen. Dianne Feinstein of California was shown arguing that illegal immigrants are good . . . 'citizens.' Said Feinstein: "They pay taxes, their children are Americans, they go to schools, they're good citizens and they're needed." This was in line with the fait accompli argument advanced by La Raza representative Janet Murguia. She referred to what she estimated as the 11-12 million illegal aliens in the country as "people are working in backbreaking work that nobody else wants to do in this country. We need to . . . understand that they are already part of this country." "They're doing work others won't do" has become the mantra of pro-immigration advocates. Others, such as National Review's Rich Lowry, say that argument is is easily refuted on logical and economic grounds. The morning's other guest was CNN's Lou Dobbs. On outsourcing and trade, I find that Dobbs' populism verges on demagoguery. But here, he was, if you'll excuse the expression . . . en fuego. Guest host Campbell Brown acknowledged that Dobbs has made immigration his issue: "you own it." Dobbs: "You cannot reform immigration if you cannot control immigration. And you cannot control immigration unless you control and secure your own borders. The rest of this is obfuscation and sham." Dobbs denied Campbell's assertion that Congress is doing just that, addressing border security: "If you would like to tell me how they're doing it? They're adding no border patrol. I was talking to Gov. Bill Richardson of NM last night. He was promised 269 border patrolmen this year - he has seen none of them." When Campbell plumped for one of the guest-worker programs, Dobbs fired back: "The 'comprehensive solution' is utter nonsense. It's language that means nothing. The fact is that we don't know how many illegal immigrants are in this country. The estimates range from 11 million to 20 million. . . . [11 million] is being commonly used because it suits the convenience of the agendas of the various parties. Bear Stearns did a study last year in which they extrapolated as many as 20 million illegal immigrants. . It means a shift of 6-10 congressional seats based on those numbers alone." Brown then let her true MSM colors show with a softball question to Murguia implying that opposition to illegal immigration is veiled racism: "What are the racial undertones to this debate for many people? Is that something that worries you?" Murguia was only too happy to be worried, alleging that there are "racial undertones, anti-ethnic overtones." That's when Dobbs got off perhaps his best line of the morning. "The National Council of La Raza is talking about race? La Raza - what does that mean? It means 'the race'!"
